By visiting the GameClick web site you agree to be bound by the following terms of use. If you do not agree with these terms of use, you should not use the GameClick web site. Please read them carefully:
Registering a Rental Account
Customers must be at least 18 years of age and have a valid credit card/debit card to join the GameClick Rental service. When completing the registration form, you agree to provide true, accurate, current and correct information about yourself. You also agree to maintain and update your information on the ‘Members Area’ page.
If GameClick has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GameClick has the right to suspend or terminate your account and refuse any and all current or future use of the GameClick rental service.
Renting Games
Rental requests are fulfilled Monday to Friday. We will send you a confirmation email when you return a game and when we send you another game. You can view currently rented items by accessing your account. All games remain the property of GameClick at all times. Games must not be sold on or made available to hire by the subscriber. You may not copy or alter any rented game in any way. Please handle the games with care so as not to damage them. You agree to treat the games and their associated packaging with the utmost care at all times. You agree that we may charge your payment method if a game is returned in an unacceptable condition (beyond reasonable wear and tear). In this event, we will give you advance notice before charging you. We will charge you the full retail price of the damaged game title. The Recommended Retail Price constitutes the most competitive retail price available to GameClick. Occasionally games may be lost in the post. In this situation, GameClick may, at their sole discretion, dispatch a replacement of the expected game.
Delivery and Return of Rental Games
We currently use ‘An Post’ to deliver and return the games you have selected to play (Northern Ireland Royal Mail). Actual delivery times may vary for you depending on (i) our stock availability, (ii) your delivery address, (iii) when you make your selection and (iv) circumstances impacting delivery by the postal service. GameClick is not responsible for delayed or misdirected mail. Return postage of rented games is paid by GameClick. You agree to report to GameClick Ltd any possible loss or late delivery of a game to you within 7 days of receipt of the confirmation of game dispatch email you will receive from GameClick. Customers are obliged to comply with either An Post’s claim compensation process or GameClick Ltd’s process. Failure to comply with these processes, as amended from time to time, will result in a charge being made for the lost disc.
You agree to obtain Proof of Posting on all games you return to us. These can be obtained free of charge from any Post Office.
You agree that if a returned game is lost in the post, you will provide to us the original Proof of Posting by recorded delivery within 7 days of the loss being identified (retain a copy for your own records).
You understand that GameClick reserve the right to charge your debit/credit card for up to the full retail price of any lost game, if you fail to adhere to the above terms. We will notify you of any such charges.
Any games reported by you as not being received will require you to complete an An Post claim form for the missing games. Failure to sign and return the claim form to GameClick is deemed that you do not support the claim and GameClick reserve the right to debit your account €50 per missing game. Claim forms must be returned to GameClick via recorded delivery within 7 working days of receipt.
Lost/ Unreturned / Damaged Games
You agree to allow us to charge your credit/debit card for the recommended retail price of a game in the following situations: (a) If you have not returned a game to us within 7 days of setting a request to cancel against your account or cancelling your free trial or paid subscription; (b) If more than one game has been reported as missing inbound on your account (c) If you have lost a game and reported it to us as lost; or If you have damaged a game whether or not you reported it to us as damaged.
Rental Subscription Fees and Billing
GameClick will charge your subscription fee to your credit card/debit card and it is calculated on a monthly basis. Billing will commence at the beginning of your subscription and monthly thereafter until you cancel.
We will continue to bill your credit card on a monthly basis until you cancel your membership. All GameClick membership is based on a month-to-month subscription. As a subscriber to GameClick you understand and agree that GameClick is authorised to charge the monthly subscription fee, and any other charges you may sustain relating to your use of GameClick , directly to your credit card/debit card each month unless and until such a time that the subscription is cancelled by the subscriber.
GameClick will automatically charge your credit card each month on or after the calendar day corresponding to the commencement of your subscription. Visit ‘Members Area’ for details of the commencement date for your next renewal period. If your subscription commenced on a day not included in a given month we will charge your credit card on the last day of such a month. GameClick may change the fees and charges in effect, or add new fees and charges from time to time, but will always give you prior notice of any changes by email in sufficient time to enable you to cancel your subscription should you so choose.
If you want to use a different credit/debit card or if there is a change in your credit/debit card validity or expiration date, you may edit your credit card information on the ‘Credit Card Details’ page of your account. GameClick reserve the right to charge you an administration and security fee of €10.00 for any refused monthly payments to your account and for each 10 day period the account remains in arrears as a result of your credit / debit card being continually declined by your bank or credit card company. GameClick reserves the right to make further charges to your account if the account is referred to debt collection to cover the costs of debt recovery and court action. GameClick is not responsible for any additional bank fees, interest charges, finance charges, over draft charges, or other fees resulting from charges billed by GameClick. We also reserve the right to change our fees, but we will notify you in advance if we do so.
Cancelling the Service by the Subscriber You may cancel your GameClick subscription at any time. All requests to terminate your subscription must be made via the GameClick web site. To cancel your account press the ‘Cancel Account’ button in the ‘Members Area’ section of your account.
Cancelling your subscription or account will stop further games being dispatched to you and set a cancellation request to your account. The cancellation will only take effect and billing will stop once all your currently rented games have been returned and received by GameClick. Please ensure your existing games rentals are returned and received by GameClick before your next billing date to prevent your account being billed for another monthly subscription. Failure to return your existing games rentals within 7 days of a cancellation request being set on your account will also result in your credit/debit card being charged up to the recommended retail price of all outstanding games on your account. Please note refunds will not be given for cancellations part way through a billing period.
Returning Games for Account Cancellation When returning games prior to cancelling your account, you must obtain a 'Proof of Postage' receipt from ‘An Post’ to confirm the games have been returned safely and before your next billing date. A 'Proof of Postage' Receipt can be obtained at anyPost Office counter and is free of charge. This will prevent any further charges being made to your account for non returned games. Any games lost in transit prior to or after cancellation without a 'Proof of Postage' receipt will be deemed as lost by the customer. GameClick reserves the right to debit the subscribers’ credit/debit card the Recommended Retail Price of any lost game.

Customers who cancel their rental subscription or whom set up accounts without activating a subscription will have their account placed on "Buy Only" status. Buy Only status allows for instant reactivation / activation of a subscription at any time by the customer. Our billing system will periodically test that the card attached to the account is valid and active by placing a pre authorisation request from your bank in the amount of €0.10 This pre authorisation will not be settled / charged but may show up on your bank statements (particularly for Laser cards) as a charge and refund.
Fair Usage And Restrictions
Gameclick Ltd observes a fair usage policy. We currently implement a 6 rents/games per month threshold on the Gold Plan and 5 rents (max of 10 games per month) threshold on the Platinum Plan. The Silver plan is limited to 2 games per month. Game rental returns not received by us prior to the monthly billing date on the silver plan will be considered to be one of the two rentals for the next monts plan. We therefore advise all Silver plan customers to return their second game in plenty of time to allow the game to be processed before the next monts subscription cycle begins. Gameclick reserves the right to deviate from this general policy from time to time in certain circumstances.
Right to Terminate by GameClick

Right to Terminate by GameClick
GameClick reserves the right, at any time, to cancel the subscription of any subscriber without being obliged to give any reason for so doing, except that if such cancellation takes place during a billing period for a reason other than a breach of these terms and conditions by the subscriber, GameClick will refund any pre-paid subscription un-utilised at the time of cancellation.

You will have an opportunity to check and correct any input errors in your order up until you click the "Place your Order" button. After you submit an order we will give you an Order Reference Number and details of the products you have ordered. We will send the same details to you in an email acknowledging receipt of your order (Order Acknowledgement). This process is automated. We will then send a further email when we start dispatching your order (Order Dispatch). Please note that these emails are both acknowledgements, not acceptance of your order. Important: Acceptance of your order and the creation of a legally binding contract between us will only occur when we debit your credit or debit card and dispatch the products to you, whichever is earlier. When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks with Experian Limited or other agencies. In particular, we may pass your details to Experian for them to check against certain public and private databases. Experian may keep a record to use in future security checks. This helps to protect you and us against fraudulent transactions. We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.
Prices and Payment
All prices and charges on the Online Shop are in Euros and include VAT of 23%. The total cost of your order will be the price of the products you order. All these will be set out clearly in your Shopping Basket before you submit your order. Prices, offers and products are subject to availability and may change before, but not after, we accept your order. If something becomes unavailable we may offer you an alternative. We try very hard to ensure that all information in the ‘Game Store’ is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we will contact you to ask whether you wish to continue with your order at the revised price or cancel it.
We accept payment by most major credit and debit cards. Payment is deducted when we process your order. We use Realex to process all payments and do not hold full customer card details. We do store the four last digits for identification and cross referencing purposes. Realex are a well established and secure payment gateway provider.

All our prices include delivery at no extra cost.
Where We Deliver
Delivery must be to an address in Ireland or the United Kingdom. Please make sure you keep the receipt enclosed with your goods. Delivery Charges Delivery is normally free however we may charge for delivery of the goods to you if circumstances dictate that it is logical to do so. Delivery charges will be clearly laid out on the website during the order process.
How and When We Deliver
Delivery must be to an address in Ireland or the United Kingdom. Please make sure you keep the receipt enclosed with your goods. Delivery Charges Delivery is normally free however we may charge for delivery of the goods to you if circumstances dictate that it is logical to do so. Delivery charges will be clearly laid out on the website during the order process.
How and When We Deliver
We use An Post to deliver your orders in the ROI. Northern Ireland and the UK will vary. Delivery times are calculated in working days (ie Monday to Friday inclusive, but excluding Bank Holidays). If you order after 1pm, please calculate your delivery time as if your order had been placed the following working day. Please allow five working days from receiving the Order Dispatch email before contacting us regarding a late delivery. Please note that we have to allow 21 working days to elapse before investigating postal loss further. Important: We do everything we can to meet the delivery times specified in this section. However, occasionally delivery times may be affected by factors beyond our control (e.g. problems obtaining authorisation for your payment) and therefore they cannot be guaranteed. We will inform you if we become aware of an unexpected delay.
Missing, Damaged or Incorrect Orders
We try very hard to ensure that you receive your order in pristine condition. If you have not received your order within the time periods set out above contact us via the ‘contact us’ section of the website. In the unlikely event that a product arrives damaged or faulty, please follow the instructions below.

We suggest you keep a printed copy of these Terms and Conditions and our Returns Policy with your receipt for future reference. Please note that GameClick can only refund postage costs where the return is a result of an error on our behalf or the unit is faulty.
Cancellations
You may cancel your purchase at any time either before or up to 14 days following the day the products are delivered. You can do this by following our returns policy. Please also note the cancellation terms for new and pre-owned products as stated below.
Cancellations of New Products
In order to qualify for a refund, your product must be complete and in 'as new' condition e.g. the box must not be damaged or marked and the product must still be sealed in its wrapping. The product must not have been used or installed. If the seal is broken, you will not be entitled to a refund if you wish to cancel the purchase.
Cancellations of Pre Owned Products
Once your order has been placed, we are unable to cancel pre owned orders. You may exercise your right to cancel the contract by notifying GameClick within 8 [eight] days of your order being placed via our online ticket system. Outside of 8 [eight] days, GameClick reserves the right to refuse any refund or exchange requested for pre owned items which are not faulty. Please note: items must be returned to GameClick for any refunds or exchanges to take place. Please see our Returns Policy for more information. If you follow the above steps, we will issue you with a full refund or replacement for the product.
Returns Policy and Warranty
The following are guidelines for all goods ordered for delivery. Wherever possible we will respond to your individual circumstances.
GameClick offers a twelve [12] month warranty on all games software. The GameClick twelve [12] month warranty only covers software faults arising in the course of normal use. Customers must notify us of a product fault via our online ticket system within 8 [eight] days after delivery. Notification received outside of the 8 [eight] day period will void this Warranty.
Defective merchandise will be fully tested to verify the fault. Should an item not be found to be defective it will be dispatched back to you, however should an item be found to be defective we will first seek to repair the item; if no repair can be made, we will seek a replacement item. If no replacement can be issued, a refund will be given. Repairs can take up to 28 working days.
To qualify for a refund or exchange the product must be in otherwise 'as new' condition; complete with any accessories and free gifts offered with it; and if possible, with the original box and packaging.

All items sent to GameClick for refund or return, are made pursuant to a shipment contract. Prior to GameClick receiving such items the risk of loss and title for such items remains with the customer. This means that the risk of loss and title for such items passes to us upon delivery from the carrier. As such, GameClick recommends that when sending items for return or refund you use an insured and/or traceable method of transit, such as Recorded Delivery.
You should return the products in accordance with the above procedure. This warranty does not cover faults caused by accident, neglect and misuse, nor does it cover damage to or deterioration of the products resulting from normal wear and tear. Important: This returns policy does not affect your statutory rights.
